These Terms and Conditions contain provisions that appear in similar text and style to this clause and which:<\/p><ul class=\"list-disc pl-6 space-y-1 mb-4\"><li>1.2.1 may limit the risk or liability of EZY SWITCHGEAR; and\/or<\/li><li>1.2.2 may create risk or liability for the Client; and\/or<\/li><li>1.2.3 may compel the Client to indemnify EZY SWITCHGEAR; and\/or<\/li><li>1.2.4 serves as an acknowledgement, by the Client, of a fact.<\/li><\/ul><p class=\"mb-3\">These Terms and Conditions apply to users of our Products and Services as described herein. Our services are made available subject to these Terms and Conditions as set out below, including, but not limited to policies, notices as well as any documents that are referred to in clauses set out in these Terms and Conditions.<\/p><p class=\"mb-3\">By making use of our services, you agree to be bound by, and to comply with, these Terms and Conditions and any further Terms and Conditions that EZY SWITCHGEAR may prescribe from time to time. The Client&#8217;s access to and use of our services is solely at the Client&#8217;s own risk.<\/strong><\/p><p class=\"mb-3\">3.3. Our website may contain links to other websites. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. We encourage you to read the privacy policies or statements of the other websites you visit.<\/p><p class=\"mb-3 font-semibold\"><strong>3.4. We reserve the right to claim damages from and\/or institute criminal proceedings against a Client for misuse or infringement of any content belonging to EZY SWITCHGEAR.<\/strong><\/p><p class=\"mb-3\">3.5. Use of our products and services does not confer any rights, licenses and\/or permissions on the Client unless expressly set out in these Terms and Conditions.<\/p><p class=\"mb-3\">3.6. The Client hereby agrees not to use our products and services for any purpose that is unlawful, improper or prohibited by these Terms and Conditions or laws of the Republic of South Africa.<\/p><p class=\"mb-3\">3.7. A breach or violation of any of the terms of these Terms and Conditions will result in the immediate termination of the services being provided or to be provided to the Client.<\/p><p class=\"mb-3\">3.8. We reserve the right to refuse to provide our products and services to any persons, at any time or occasion which we may deem necessary.<\/p><p class=\"mb-3\">3.9. Certain products and services and other services incidental thereto may be made available exclusively by EZY SWITCHGEAR, which may change from time to time.<\/p><p class=\"mb-3\">4.2. The Client acknowledges that the Service Providers&#8217; Terms and Conditions of service shall govern the use of such platform or component as between EZY SWITCHGEAR and such Service Provider. The Parties further record and agree that EZY SWITCHGEAR shall, at any time during the term of this Agreement, be entitled to appoint and\/or terminate the services of such Service Providers provided that such appointment and\/or termination of Service Providers shall not be materially detrimental to EZY SWITCHGEAR&#8217;s performance of its obligations and\/or compromise the service levels agreed to in terms of this Agreement.<\/p><p class=\"mb-3\">4.3. EZY SWITCHGEAR hereby agrees to ensure that the standard of the Products and Services it shall provide to the Client in terms of this Agreement shall be in accordance with relevant industry standards.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3869db jltma-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"b3869db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. EZY SWITCHGEAR guarantees its equipment and completed projects against defects in materials and workmanship for a period of <strong>12 (twelve) months<\/strong> from the date of delivery. All our equipment and completed projects undergo comprehensive testing and the report is signed off by a professional engineer.<\/p><p class=\"mb-3\">This Warranty however excludes flashes caused by cable terminations, cable boots, rodents, improper installation, cable terminations not properly secured by cable glands which exerts force on the bushings, over torquing the cable bolts on the bushing, any changes to the product including but not limited to any changes to mechanisms, opening closing and auxiliary coils additions or replacements.<\/p><p class=\"mb-3 font-semibold italic\"><strong>5.2. Please refer to the Warranty Letter attached hereto for the full warranty specification.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a2f2429 jltma-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"a2f2429\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">6. Returns and Repairs Policy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-beb7bae jltma-glass-effect-no elementor-widget elementor-widget-spacer\" data-id=\"beb7bae\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f3460ad jltma-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"f3460ad\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"mb-3\">6.1. Purchases may be returned to EZY SWITCHGEAR&#8217;s workshop subject to the QR Code and Vibration Indicator still being intact, and that the product is in its original condition. In line with the CPA a handling fee of up to 15% of the value of the product may be charged when the product\/packaging is not returned in its original purchase condition.<\/p><p class=\"mb-3\">6.2. The Client is to ensure that the goods are properly packaged as not to sustain damages whilst in transit. Any abuse, tampering, incorrect installations, mismatching and damage due to natural disasters will not be covered under the above warranties.<\/p><p class=\"mb-3\">6.3. The Client will be entitled to one of the following options as per the CPA, on election of EZY SWITCHGEAR (after goods have been inspected and assessed):<\/p><ul class=\"list-disc pl-6 space-y-1 mb-3\"><li>6.3.1. Have such product repaired; or<\/li><li>6.3.2. Have the product replaced; or<\/li><li>6.3.3. Be refunded the price paid which shall be the maximum value of any claim whatsoever which the Client may have against EZY SWITCHGEAR;<\/li><li>6.3.4. In the event that the product is found to be not faulty, the Client will be liable for all handling and shipping charges. If no prior arrangement has been concluded and accepted by EZY Switchgear PRIOR to order acceptance, units will ONLY be dispatched upon receival of the 30% balance as per the accepted quotation.<\/p><p>7.8. In accordance with The National Credit Act 34 of 2005, interest to the rate of 2% per month will be charged on late payments exceeding 20 calendar days where arrangements were accepted and not adhered to.<\/p><p>7.9. A Tax Invoice will only be issued to reflect the amount received and only a pro forma invoice can be issued in the interim and only on request.<\/p><p>7.10. A notification will be sent together with the final invoice for payment once the unit refurbishment\/service\/repair has been finalised. Although the final payment is due on or before collection of the unit, the collection of the unit may not be deferred more than 30 calendar days to defer payment of the invoice.
